Spotlight on Legal Issues

Copyright is the legal protection granting the owners of creative works (such as books, music, artwork, and so on) the authority to control their use, distribution, and sale. Copyright is a limited right, with key exceptions such as fair use. Fair use allows people to use copyrighted works for transformative purposes, such as commenting, reporting, and criticizing. Noncommercial uses are particularly favored as fair uses.

For Fair Use Week 2025, we want to spotlight recent discussions about Fair Use and highlight its importance for transformative works, because fair use makes fanworks legal under copyright law.

OTW’s Legal team is currently keeping an eye on site-blocking legislation, which has the potential to be overly broad and has been reintroduced in the new US Congress. We're also watching some interesting cases, like one against Jimmy Kimmel for his videos mocking George Santos' Cameos. Legal’s Rebecca Tushnet submitted an amicus brief in that case, defending Kimmel’s right to make fun of Santos. Another recent legal dispute saw tattoo artist Kat Von D sued by a photographer whose photo she used as a reference for a tattoo—she won a jury verdict that some of her uses of the photo were fair uses, and the tattoo itself was not an infringement. The Authors Alliance, which supports the interests of authors in strong fair use rights and strong protections against publishers’ attempts to make authors surrender their rights, submitted an amicus brief in support of fair use.

The US Copyright Office also recently released a section of a report on AI and copyright focusing on when AI-generated works are copyrightable. The Office concluded that human involvement in creation is required for copyrightability and that merely providing a prompt—even a detailed prompt refined over multiple attempts—does not represent enough human involvement to satisfy that requirement. As a result, the Copyright Office will accept works with AI-generated components, like the credits in a live-action film, but purely AI-generated works will not be considered copyrightable human creations. The Office is also expected to issue a report on AI training and fair use in the coming months. However, the Copyright Office does not decide most issues of fair use and its recommendations will not be binding in courts.

Another set of fair use developments comes from the US Copyright Claims Board, a small-claims proceeding set up by the Copyright Office. It was started in 2020 to handle some copyright claims more cheaply than litigation in federal court. Although there are some serious problems with the setup, the Board is not a rubber stamp for copyright owners – they do not always side with them. One example comes from a recent decision which found that a YouTube feud, where one YouTuber brought a claim against another for using clips of her work, involved fair use and not infringement.

It’s absolutely critical that fair use remains a robust exception to copyright, as it’s the foundation of transformative works’ existence—including, but not limited to, all types of fanworks.

As the OTW, we are committed to defending the right of transformative works to exist. Our Legal team works hard to stay on top of recent developments involving copyright law. And we want you to know your rights: exercising fair use rights and reminding people that copyright is not absolute keeps fair use healthy. Since the end of December 2024, AO3 has had numerous periods of slowness, downtime, and related issues such as missing kudos emails and delayed invitations. We've been taking some steps to improve the situation, but we are also working on some highly time-sensitive updates to our infrastructure, so we can't spend as much time as we'd like on performance improvements. We expect some slowness and downtime to continue until our new servers are delivered and installed in a few months.

We first noticed some strain on the servers we use for Elasticsearch (which powers searching and filtering) in the middle of last year. The new servers we wanted weren't available yet, so we repurposed some of our other servers to help with the load on Elasticsearch until we could get the hardware.

Unfortunately, the hardware wasn't available on its October release date, and our temporary fix couldn't hold up to the traffic increase we experience at the end of every year. This has led to periods of noticeable slowness over the last several weeks.

The servers we wanted finally became available in early January, and we completed the process of getting quotes and requisitioning them by January 15. Our purchase was confirmed on January 28, but it will take a few months for the servers to be delivered and installed.

We estimate the new Elasticsearch servers will be in place by early April. Until then, you might run into the following issues, especially during busy periods:

  • all pages loading more slowly
  • Elasticsearch-powered pages like search results and work and bookmark listings taking longer to update
  • error pages
  • automated checks from Cloudflare's Under Attack mode
  • stricter rate limiting
  • issues with services like the Wayback Machine or Tumblr RSS accounts that rely on bots, scrapers, or other automated tools, which we have deprioritized in favor of traffic from users

In addition to new Elasticsearch servers, we'll be purchasing five database servers to improve the capacity and resilience of our database cluster. We don't currently have enough database power to handle increased traffic and do certain types of maintenance at the same time. This means we sometimes have to take AO3 offline to resolve database issues, as we did for our February 7 maintenance. Additional hardware should help us avoid this situation in the future, but it will take some time for the purchase to be completed and the servers to be installed. We do not anticipate any database issues while we wait and there is no risk of data loss.

We're very sorry for the disruptions, and we appreciate your patience and your generous donations, which fund purchases like these.

Open Doors Technical Volunteer

Do you know SQL and Python or other programming languages and want to rescue at-risk fan archives?

The Open Doors project receives many requests to rescue fan sites that are at risk of disappearing because their owners can no longer maintain them. The sites we import to the Archive Of Our Own range from database-driven archives based on common software packages like eFiction and Automated Archive to hand-coded HTML sites that are over twenty years old!

As a technical volunteer for Open Doors, you will process the contents of legacy sites to do the following:

  • analyse the original data to find all the content and metadata needed for the import
  • remove spam, legacy navigation and personal information from HTML files
  • convert tags to official AO3 tags as specified by the Tag Wrangling team
  • ensure chapters are correctly combined into complete works
  • resolve duplicates, such as works already imported to AO3 by their creators or previous imports
  • convert the cleaned data to MySQL tables in a standard format that can be ingested automatically into the Archive

As the person responsible for ensuring that all the content from the original site is correctly imported to the AO3, you will have an excellent eye for detail and an ability to work independently within the rules of Open Doors. You will also liaise regularly in chat with other Open Doors volunteers, keeping them up to date with your progress on your assigned tasks.

To apply for this role, you must be at least 18 years old and legally of age to open explicit fanworks in your local jurisdiction.

Please note that you will be asked to complete a short coding test (which should take you less than 1 hour, to be returned in 1 week) as part of your application.

Policy & Abuse Volunteer

The Policy & Abuse committee (PAC) is responsible for addressing questions and concerns about potential violations of AO3's Terms of Service. We determine whether reports are about legitimate violations of the Terms of Service, and what to do about them if they are. PAC volunteers correspond directly with AO3 users and collaborate on projects both within PAC and with other OTW committees.

Our main goals as a committee are:

  • to adhere to the AO3 Terms of Service
  • to make our reasoning and processes as clear and transparent as possible
  • to handle all user reports consistently, no matter which volunteer is doing the work
  • to keep every case we work on completely confidential

We are seeking people who can:

  • Commit to working on cases regularly
  • Be patient with rephrasing explanations
  • Ask for help when needed
  • Collaborate both inside the team and with other committees
  • Act in accordance with established rules, policies, and procedures
  • Treat confidentiality and user privacy as a priority

Please note: you must be 18+ in order to apply for this role. While English proficiency is required, we welcome applicants who are fluent in other languages, especially Spanish (Español), Brazilian Portuguese (Português brasileiro), Russian (Русский), Chinese (中文), or Indonesian (Bahasa Indonesia).

Tag Wrangling Volunteer

The Tag Wranglers are responsible for helping to connect and sort the tags on AO3! Wranglers follow internal guidelines to choose the tags that appear in the filters and auto-complete, which link related works together. This makes it easier to browse and search on the archive.

If you’re an experienced AO3 user who likes organizing, working in teams, or having excuses to fact-check your favorite fandoms, you might enjoy tag wrangling! To join us, click through to the job description and fill in our application form. There will also be a short questionnaire that will help us assess whether you have the skills and attributes that will lead to your success in this role.

Please note: you must be 18+ in order to apply for this role. For this role, we’re currently looking for wranglers for specific fandoms only, which will change each recruitment round. Please see the application for which fandoms are in need.

Wranglers need to be fluent in English but we welcome applicants who are also fluent in other languages, especially Bahasa Indonesia (Indonesian), Čeština (Czech), Español (Spanish), isiZulu (Zulu), Italiano (Italian), Polski (Polish), Português brasileiro (Brazilian Portuguese), Suomi (Finnish), Tiếng Việt (Vietnamese), Türkçe (Turkish), Русский (Russian), and ไทย (Thai) — but help with other languages would be much appreciated!

International Fanworks Day

This International Fanworks Day (IFD), we once again celebrated fandom and its myriad communities. Now that the festivities are over, we at the OTW want to thank everyone who participated in making IFD2025 happen!

Be it by posting works tagged with the International Fanworks Day 2025 tag on AO3, by taking part in the IFD 2025 Fanlore Challenge, or by participating in Feedback Fest on AO3 or the OTW website, and sharing your favorite fanfics with fellow fans; we appreciate every single one of you for contributing!

Over on Discord, we spent 30 hours playing games and chatting about all things fandom. Besides IFD classics like List Builder and Five Things, we also tried some new games like Fandom Emoji Quiz, and brought back Poetry Round Robin! You can find our fan-written poems, as well as re-written song texts from Lyrics Round Robin on our IFD account on AO3.

International Fanworks Day

For anyone who’s missed our earlier posts, you can find all of our activities for this year's International Fanworks Day here

The OTW’s chatroom games session is a 30-hour party that lasts from February 14th, 21:00 UTC until February 16th, 03:00 UTC. The game times listed below are all in UTC, but you can click the links to find out how that converts to your own timezone.

The games will be hosted on our dedicated Discord server and moderated by OTW volunteers throughout the day. Every hour you will be able to participate in a different fandom-themed game! The timetable and game descriptions are posted below; join us on Discord for the games you’d like to play!

5 Things  (5 scheduled)

How to Play : During this game, the host will name a topic and players in the room will call out examples from their favorite fandoms. This will repeat for at least 5 rounds. Be prepared to explain why your answer counts (maybe you’ll recruit someone new to your fandom!)

20 Questions  (5 scheduled)

How to Play : One person thinks of an object, animal, or person, but instead of answering questions, they ask them. Other players must deduce what the thing is based on the questions. 

Fandom Emoji Quiz  (4 scheduled)

How to Play : The host will paste into the chat 3 emojis that represent a fandom. The first person to guess a fandom correctly wins the round, and the person with the most points after all rounds wins the game.

List Builder  (5 scheduled)

How to Play : List Builder is a collaborative game in which players work together to come up with a list of fandom characters or items belonging to a particular genre, starting with consecutive letters of the alphabet. Start at A and work your way through to Z (you can be as flexible as required on the difficult letters!)

Lyrics Round Robin  (3 scheduled)

How to Play : During this game, we’ll collectively write FANDOM lyrics to replace those of a familiar song. The host will choose the song and type out an alternate first two lines. Then those in the room will write the next lines until the song is finished.

Poetry Round Robin  (3 scheduled)

How to Play : During this game, we'll collectively write FANDOM poetry! The host posts a poem as an example of a specific poetic form (like sonnet, haiku, etc.), as well as a title. The players then write one (or more) original poems of that form together, one line at a time.

Trivia  (3 scheduled)

How to Play : Like most trivia games, the host will ask a question and the first person to answer correctly wins that round. Because we’re online and you’re free to do searches we’re going to add another factor, which is time — you must answer within 2 minutes. But you can call out your answer as soon as you think you know. If you’re the first to have the correct answer, the host will type your name and award you a point. At the end of the game, whoever has gotten the most points will be named the winner!

Two Truths, One Lie  (2 scheduled)

How to Play : The host will paste into the chat 3 statements. Because we’re online and you’re free to do searches we’re going to add another factor, which is time — you must answer within 30 seconds after the third statement!

International Fanworks Day

There are only a few days left for February 15th, meaning it’s almost time for the eleventh annual International Fanworks Day (IFD)! For #IFD2025, we have planned plenty of activities for fans around the globe. Take a look at them today to find out which activities you can participate in!

  1. Feedback Fest: As per usual, we are holding our annual feedback fest! This is your chance to tell others about your favorite works related to your fandoms, fic dynamics, or things you believe have strongly impacted the fandom ecosystem! Look for our Feedback Fest post on February 13th, then leave a comment with 10 fanwork recommendations! On social media, use the tag #FeedbackFest when posting.
  2. Using the #IFD2025 or #IFDChallenge2025 tags, share your experience with fandoms as ecosystems on social media!
  3. Tag your works on AO3 centered around fan communities with our International Fanworks Day 2025 tag!
  4. The festivities aren’t just on AO3: Fanlore, the OTW’s fannish history and culture wiki, will be celebrating as well! The challenge runs February 10-16 and involves a new editing challenge to complete every day. To participate, refer to the IFD 2025 Fanlore Challenge page for more information.
  5. Games and Fan Chat: On February 15th, we’ll be hosting a chat on the OTW’s Discord. Join us between 21:00 UTC February 14th (What time is that for me?) and 03:00 UTC February 16th (What time is that for me?) to play trivia games and chat with other fans! The chat room will be moderated in English, and we’ll post a detailed schedule on the 15th.

I. SPOTLIGHT ON OPEN DOORS

In December, Open Doors completed imports for Elysejský klíč, a Czech-language Harry Potter archive; VinXperience, a message board with fanfiction featuring characters played by actor Vin Diesel; Between the Lines, an archive of JAG fanfiction including a great deal of Mac/Harm fic; Smoochies, a site dedicated to bishounen, shounen-ai, and yaoi fanworks; and All About Spike, a Buffy and Angel archive focussing on the character Spike.

Their annual announcement celebrated the completion of nine archive import projects in 2024, with over 13,000 works!

They also announced the upcoming imports of Slash Advent Calendar, a multifandom slash challenge that ran every December from 2002 to 2005; MuggleNet Fan Fiction, a Harry Potter fanfiction archive; and Remembering Tiger Lily Roar, a memorial archive for a well-loved fanfiction writer.

II. AT THE AO3

In January, Accessibility, Design & Technology published release notes detailing recent AO3 code updates. They also migrated their library to store collection, skin, and pseud icons.

Support received 2,207 tickets in December; ticket levels remain high due to ongoing server issues and site disruptions.

Tag Wrangling finalized another round of updates to some Additional Tags not specific to any fandom, otherwise known as No Fandom tags. They have also continued work behind the scenes on a streamlined process for dealing with small synonym changes to No Fandom tags, an alteration on their existing fast-track procedures.

In December, volunteers wrangled more than 560,000 tags across more than 69,000 fandoms - more than 1,300 tags per wrangling volunteer!

Also in December, Policy & Abuse received 2,559 tickets, totalling to just over 28,000 tickets in 2024! Check out the pie chart for more details.

Policy & Abuse received approximately 28,000 tickets in 2024. These categories reflect the subject of the complaint, and (with the exception of Offensive Content), do not indicate whether the report was upheld or rejected.

III. ELSEWHERE AT THE OTW

Communications has been working hard this month preparing for International Fanworks Day (IFD) in February! They’ve been collaborating with Translation to make IFD news posts available in many languages. Communications also celebrated the OTW TikTok passing 10,000 followers! Last but not least, they’ve been busy scoring the trivia game held to celebrate AO3’s fifteenth anniversary.

To close out 2024, Fanlore ran an editing chat, and it was a lot of fun! They are also preparing for the annual IFD Fanlore Challenge, as well as Femslash February this month! Keep an eye on their Twitter/X and Tumblr for more details.

In January, TWC began preparations to publish two special issues: Gaming Fandom and Disability and Fandom. They also counted down their top 20 #TWCHits over on Bluesky!

Also in January, Development & Membership's convention outreach coordinated OTW's attendance at Arisia in Boston, Massachusetts, US! Keep an eye on the OTW's social media, such as our Tumblr and Bluesky, for future convention attendance updates.

IV. GOVERNANCE

Board, in conjunction with the Board Assistants Team held their first quarterly meeting of 2025 in the Board Discord server. During the meeting, they shared decisions made since the last meeting, a wrap-up on the AO3 Terms of Service update, updates on the 2024 Culture Roadmap, and the new 2025 Board Roadmap. They also received a number of questions, both those submitted asynchronously in advance and those asked during the meeting, and all were answered live. Meeting minutes will be made available on the OTW website soon.

Legal spent December and January closely monitoring new laws, lawmaking proposals, and legal developments around the world that could affect fans. V. IT'S ALL ABOUT THE PEEPS

On December 5, Volunteers & Recruiting celebrated International Volunteer Day 2024 and ran their organization-wide email and graphics campaign recognizing OTW volunteers' work.

From November 22 to January 21, Volunteers & Recruiting received 215 new requests and completed 321, leaving them with 37 open requests. As of January 21, 2025, the OTW has 889 volunteers. \o/ Recent personnel movements are listed below.
